Justice A.M. Khanwilkar Appointed as Lokpal Chairperson

Former Supreme Court Justice Ajay Manikrao Khanwilkar has been appointed as the new Chairperson of the Lokpal, tasked with investigating graft allegations against public officials and national leaders. Khanwilkar has over two decades of judicial experience, including serving as Chief Justice of the Madhya Pradesh and Himachal Pradesh High Courts and as a Supreme Court judge.

In a significant step towards strengthening anti-corruption institutions, former Supreme Court Justice Ajay Manikrao Khanwilkar has been named the new Chairperson of the Lokpal, tasked with inquiring into and investigating graft allegations against public officials and national leaders.

Justice Khanwilkar’s Distinguished Track Record

Justice Khanwilkar brings over two decades of extensive judicial experience, having served as the Chief Justice of the Madhya Pradesh and Himachal Pradesh High Courts, besides his six-year tenure as a Supreme Court judge until retirement in July 2022.

Known for his balanced and erudite judgments, Justice Khanwilkar headed benches delivering various landmark verdicts. These span upholding the Aadhaar scheme, decriminalizing homosexuality and adultery, permitting the entry of women into Kerala's Sabarimala temple, clearing PM Modi in 2002 Gujarat riots and confirming death penalties for Nirbhaya gangrape convicts - reflecting the range of constitutional matters he has shaped.

Critically, Justice Khanwilkar also authored the majority opinion on the ‘right to die with dignity’ in the landmark Common Cause vs Union of India case on passive euthanasia and advanced directives. Overall, his body of judicial work and administrative leadership across High Courts position him strongly to head the Lokpal.

Other New Appointees

The official notification also named other members filling the vacant posts in the Lokpal. Freshly appointed judicial members are Justices Lingappa Narayana Swamy, Sanjay Yadav and Ritu Raj Awasthi while the non-judicial appointees are Sushil Chandra, Pankaj Kumar and Ajay Tirkey.

Significantly, Awasthi heads the Law Commission and Chandra has rich experience across the Finance Ministry and Election Commission. The multi-faceted team is intended to strengthen the Lokpal’s expertise across domains like vigilance, public administration, regulatory affairs, financial crimes etc.

Lokpal’s Structure and Mandate

The Lokpal comprises one chairperson and up to eight members with equal representation from judicial and non-judicial backgrounds. Members are appointed based on recommendation of a high-powered selection panel including the Prime Minister, Lok Sabha Speaker, Leader of Opposition etc.

Its mandate involves probing graft allegations against a spectrum of public functionaries from the Prime Minister, ministers, parliamentarians to senior bureaucrats. Preliminary inquiries determine cases with adequate basis, followed by full-fledged investigation potentially leading to prosecution based on gathered evidence.

Besides the chairperson vacuum, three other posts have also remained vacant, crippling the Lokpal and hindering the progress of pending cases. Therefore, there existed urgent need to fill the leadership positions, provide direction and restore momentum.

Justice Khanwilkar, given his recognized sharp legal acumen and administrative skills directing High Court operations in leadership roles, is deemed the ideal candidate to steer the Lokpal with decisive authority.

Upholding Lokpal’s Independence

Moreover, expectations run high that Justice Khanwilkar would leverage his rich experience and credentials to strongly uphold and safeguard the Lokpal’s independence, neutrality and non-partisanship. Such autonomy remains vital for thorough and unbiased investigations against corruption allegations touching the highest political levels without fear or favor.

Curbing external interference that weakens anti-graft agencies has been a long-standing challenge in India, and Justice Khanwilkar has exhibited principled resolve in past Supreme Court judgments against such machinations.
